3. Erhebung und Speicherung personenbezogener Daten

Bei der Nutzung der Plattform können folgende Daten verarbeitet werden:

• Unternehmensdaten
• E-Mail-Adresse
• Login-Informationen
• IP-Adresse
• Kommunikationsdaten & Fertigungsdaten

Diese Daten werden erhoben, wenn Nutzer:

• ein Konto registrieren
• die Plattform nutzen
• Nachrichten über die Plattform austauschen
• Projekte einstellen oder Angebote abgeben

3a Verarbeitung technischer Daten (insbesondere CAD-Dateien)

Im Rahmen der Nutzung der Plattform können Nutzer technische Daten, insbesondere CAD-Dateien, Zeichnungen, Modelle oder sonstige Konstruktionsdaten, hochladen und verarbeiten.

Diese Daten können vertrauliche Geschäfts- und Betriebsgeheimnisse enthalten.

Die Verarbeitung solcher Daten erfolgt ausschließlich zur Bereitstellung der Plattformfunktionen, insbesondere zur Durchführung von Projekten und zur Kommunikation zwischen Nutzern.

Price4Parts übernimmt keine inhaltliche Prüfung dieser Daten und keine Verantwortung für deren Richtigkeit, Vollständigkeit oder Eignung.

Die Verantwortung für den Schutz, die Weitergabe und die Vertraulichkeit solcher Daten liegt ausschließlich bei den jeweiligen Nutzern.

Ein Anspruch auf dauerhafte Speicherung dieser Daten besteht nicht.

Price4Parts ist berechtigt, technische Daten nach Abschluss eines Projekts oder nach angemessener Frist zu löschen, sofern keine gesetzlichen Aufbewahrungspflichten bestehen.

Die Verarbeitung kann dabei auch über externe Dienstleister (z. B. Cloudinary) erfolgen.

4. Zwecke der Datenverarbeitung

Die Verarbeitung erfolgt insbesondere für:

• Registrierung von Nutzerkonten
• Bereitstellung der Plattformfunktionen
• Kommunikation zwischen Nutzern
• Vertragsabwicklung
• technische Sicherheit der Plattform
• Verbesserung der Plattformdiensten
• Vermittlung von Geschäftskontakten
• Überwachung und Auswertung von Kommunikationsinhalten zur Einhaltung der Plattformregeln
• Missbrauchs- und Betrugsprävention
• Durchsetzung der vertraglichen Nutzungsbedingungen
• Verarbeitung von Bewertungsdaten zur Darstellung von Nutzerbewertungen und zur Qualitätssicherung der Plattform
• Abwicklung von Zahlungen über externe Zahlungsdienstleister (z. B. Stripe)

4a. Sicherstellung der Plattformintegrität, Sicherheit und Missbrauchsprävention

Price4Parts ist berechtigt, Kommunikationsdaten sowie sonstige über die Plattform ausgetauschte Inhalte stichprobenartig oder anlassbezogen einzusehen und auszuwerten, soweit dies erforderlich ist zur:

• Einhaltung der Nutzungsbedingungen und vertraglichen Regelungen
• Sicherstellung der Sicherheit und Integrität der Plattform
• Verhinderung von Missbrauch, Betrug oder rechtswidrigen Handlungen

Eine dauerhafte oder anlasslose Überwachung der Kommunikation erfolgt nicht.

Die Verarbeitung erfolgt ausschließlich im erforderlichen Umfang und unter Beachtung der geltenden datenschutzrechtlichen Vorschriften.

Die Prüfung kann teilweise automatisiert erfolgen, insbesondere durch den Einsatz technischer Systeme zur Erkennung von Auffälligkeiten oder möglichen Verstößen.

Automatisierte Prüfungen dienen ausschließlich der Vorbereitung von Maßnahmen und werden durch Price4Parts überprüft.

Die Verarbeitung erfolgt auf Grundlage eines berechtigten Interesses gemäß Art. 6 Abs. 1 lit. f DSGVO, insbesondere zur Sicherstellung der Plattformintegrität, zur Verhinderung von Missbrauch sowie zur Durchsetzung der Plattformregeln.

4b. Rechtsgrundlagen

Die Verarbeitung erfolgt auf Grundlage von:

• Art. 6 Abs. 1 lit. b DSGVO (Vertragserfüllung)
• Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an Sicherheit, Missbrauchsprävention und Durchsetzung der Plattformregeln)

4c. Sicherheitsmaßnahmen – Zwei-Faktor-Authentifizierung (2FA)

Zur Sicherung der Nutzerkonten setzt Price4Parts geeignete technische und organisatorische Maßnahmen ein, insbesondere die Möglichkeit zur Nutzung einer Zwei-Faktor-Authentifizierung (2FA).

Für bestimmte Nutzergruppen, insbesondere Anbieter (Seller), kann die Nutzung verpflichtend sein.

Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. b und lit. f DSGVO zur Sicherstellung der Sicherheit und Integrität der Plattform.

4d. Zahlungsabwicklung

Zahlungsdaten werden ausschließlich durch externe Zahlungsdienstleister verarbeitet.

Price4Parts hat keinen Zugriff auf vollständige Zahlungsinformationen und speichert keine Zahlungsdaten.

4e. Einsatz von Drittanbietern und Auftragsverarbeitern

Zur Bereitstellung der Plattform setzt Price4Parts externe Dienstleister (Auftragsverarbeiter) ein. Diese verarbeiten personenbezogene Daten ausschließlich im Auftrag und nach Weisung von Price4Parts.

Die Plattform verwendet Cookies und vergleichbare Technologien.

4f. Affiliate-Tracking

Price4Parts kann im Rahmen eines Partnerprogramms Tracking-Technologien einsetzen, um die Vermittlung von Nutzern durch Dritte (Affiliate-Partner) zu erfassen. Hierbei können insbesondere folgende Daten verarbeitet werden:

• Referral-Parameter
• Cookies oder vergleichbare Technologien
• Zeitpunkte von Registrierungen und Transaktionen

Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an Vertrieb und Marketing).

4fg. Datenübermittlung in Drittländer

Einige der eingesetzten Dienstleister haben ihren Sitz in Staaten außerhalb der Europäischen Union (insbesondere den USA).

In diesen Fällen erfolgt die Datenübermittlung auf Grundlage geeigneter Garantien gemäß Art. 44 ff. DSGVO, insbesondere:

• Abschluss von Standardvertragsklauseln (SCC)
• Angemessenheitsbeschlüsse der EU-Kommission (soweit vorhanden)

Es kann nicht ausgeschlossen werden, dass Behörden in Drittländern Zugriff auf personenbezogene Daten erhalten.

Durch die Nutzung der Plattform erklären sich Nutzer mit einer solchen Datenübermittlung einverstanden, soweit diese zur Vertragserfüllung erforderlich ist.

5. Speicherdauer

Personenbezogene Daten werden nur so lange gespeichert, wie dies für die jeweiligen Zwecke erforderlich ist.

• Account-Daten: für die Dauer der Vertragsbeziehung
• Vertrags- und Transaktionsdaten: 6–10 Jahre (gesetzliche Aufbewahrungspflichten)
• Kommunikationsdaten: bis zu 24 Monate nach Abschluss eines Projekts
• technische Daten (z. B. Logfiles): maximal 90 Tage

Nach Wegfall des Zwecks werden die Daten gelöscht, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

6. Cookies

Die Plattform verwendet Cookies zur technischen Funktion der Website.

Analyse- oder Marketing-Cookies werden nur nach Einwilligung über ein Cookie-Consent-Tool eingesetzt.

Nutzer können ihre Cookie-Einstellungen jederzeit über das Consent-Tool anpassen.

6a. Tracking und Marketing-Tools

Sofern Nutzer ihre Einwilligung über das Consent-Tool erteilen, können Tracking- und Marketingtools eingesetzt werden, insbesondere:

• Meta Pixel (Facebook / Instagram)
• Google Tracking-Dienste

Diese Tools ermöglichen die Analyse des Nutzerverhaltens sowie die Ausspielung zielgerichteter Werbung.

Die Einwilligung kann jederzeit widerrufen werden.

6b. Datenübermittlung in Drittländer

Soweit personenbezogene Daten an Dienstleister außerhalb der Europäischen Union übermittelt werden, erfolgt dies ausschließlich unter Einhaltung der Art. 44 ff. DSGVO.

Hierzu werden insbesondere Standardvertragsklauseln der Europäischen Kommission verwendet.

6c. Einsatz von Dienstleistern

Die eingesetzten Dienstleister können entweder als Auftragsverarbeiter im Sinne des Art. 28 DSGVO oder als eigenständige Verantwortliche tätig sein.

Soweit eine Verarbeitung im Auftrag erfolgt, bestehen entsprechende Verträge zur Auftragsverarbeitung.

Soweit Dienstleister als eigenständige Verantwortliche tätig werden, erfolgt die Verarbeitung auf Grundlage der jeweiligen Datenschutzbestimmungen dieser Anbieter.

6d. Eingesetzte Dienstleister und Auftragsverarbeiter (Übersicht)

Zur Bereitstellung der Plattform setzt Price4Parts verschiedene technische Dienstleister ein.

Diese können personenbezogene Daten im Auftrag verarbeiten oder als eigenständige Verantwortliche tätig sein. Hierzu gehören insbesondere:

Soweit Dienstleister als Auftragsverarbeiter tätig werden, bestehen entsprechende Verträge gemäß Art. 28 DSGVO.

Soweit Daten in Drittländer übermittelt werden, erfolgt dies auf Grundlage geeigneter Garantien gemäß Art. 44 ff. DSGVO (insbesondere Standardvertragsklauseln).

7. Weitergabe von Daten

Eine Weitergabe personenbezogener Daten erfolgt nur:

• zur Vertragsabwicklung zwischen Nutzern
• zur Bereitstellung der Plattformfunktionen
• bei gesetzlichen Verpflichtungen
• bei Nutzung externer Dienstleister

Externe Dienstleister werden vertraglich zur Einhaltung der Datenschutzbestimmungen verpflichtet.

Bei einzelnen Dienstleistern kann eine eigenständige datenschutzrechtliche Verantwortlichkeit bestehen.

8. Zahlungsdienstleister

Zur Zahlungsabwicklung können externe Zahlungsanbieter eingesetzt werden, beispielsweise:

• Stripe
• PayPal
• weitere externe Zahlungsdienstleister

Bei Nutzung dieser Dienste gelten zusätzlich die Datenschutzbestimmungen des jeweiligen Zahlungsanbieters.

Price4Parts selbst ist kein Zahlungsdienstleister.

9. Speicherdauer

Personenbezogene Daten werden nur so lange gespeichert, wie es für die jeweiligen Zwecke erforderlich ist oder gesetzliche Aufbewahrungspflichten bestehen.

Betroffene können sich alternativ auch direkt an den Datenschutzbeauftragten wenden.

10. Rechte der Nutzer

Nutzer haben gemäß DSGVO folgende Rechte:

• Recht auf Auskunft über gespeicherte Daten
• Recht auf Berichtigung unrichtiger Daten
• Recht auf Löschung („Recht auf Vergessenwerden")
• Recht auf Einschränkung der Verarbeitung
• Recht auf Datenübertragbarkeit

11. Beschwerderecht

13. Datenübermittlung in Drittstaaten

Einige der eingesetzten Dienstleister verarbeiten personenbezogene Daten außerhalb der Europäischen Union, insbesondere in den USA (z. B. Stripe, Meta, Google, Cloudinary, SendGrid, Instantly.ai).

Die Übermittlung erfolgt ausschließlich unter Einhaltung der gesetzlichen Anforderungen der DSGVO.

Hierzu gehören insbesondere:

• Abschluss von EU-Standardvertragsklauseln (SCC) gemäß Art. 46 DSGVO
• zusätzliche technische und organisatorische Maßnahmen
• ggf. Nutzung von Anbietern mit EU-Serverstandorten (soweit verfügbar)

Trotz dieser Maßnahmen kann ein Restrisiko bestehen, dass Behörden im Drittland Zugriff auf Daten erhalten.

15. Affiliate-Tracking / Partnerprogramm

Im Rahmen unseres Partnerprogramms setzen wir Tracking-Technologien ein, um Empfehlungen zuzuordnen. Dabei können insbesondere folgende Daten verarbeitet werden:

• Zeitpunkt der Registrierung
• Abschluss kostenpflichtiger Leistungen

Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an Vertrieb und Marketing).

Hierfür können externe Tools eingesetzt werden, insbesondere Rewardful. Dabei kann eine Übermittlung von Daten in Drittländer (z. B. USA) erfolgen. Diese erfolgt auf Grundlage von Standardvertragsklauseln gemäß Art. 46 DSGVO.

Processing takes place in particular for:

4a. Ensuring Platform Integrity, Security and Prevention of Misuse

Price4Parts is entitled to inspect and evaluate communication data as well as other content exchanged via the platform on a random basis or where there is cause, insofar as this is necessary for:

• compliance with the terms of use and contractual provisions
• ensuring the security and integrity of the platform
• prevention of misuse, fraud, or unlawful acts

Permanent or arbitrary monitoring of communication does not take place.

Processing takes place exclusively to the extent required and in compliance with the applicable data protection regulations.

The review may be carried out partly in an automated manner, in particular through the use of technical systems for the detection of anomalies or possible violations.

Automated reviews serve exclusively for the preparation of measures and are reviewed by Price4Parts.

Some of the service providers used are based in states outside the European Union (in particular the USA).

In these cases, data transfer takes place on the basis of appropriate safeguards pursuant to Art. 44 et seq. GDPR, in particular:

• adequacy decisions of the EU Commission (where available)

It cannot be ruled out that authorities in third countries may gain access to personal data.

5. Storage Duration

Personal data is only stored for as long as this is necessary for the respective purposes.

After the purpose ceases to apply, the data will be deleted, provided that no statutory retention obligations prevent this.
